Terms of Service
These Terms of Service ("Terms") govern your download, installation, and use of the NaitiveKey keyboard application (the "App") and any related services (collectively, the "Service").
1. Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App and uninstall it from your device immediately.
2. Intellectual Property Rights
All intellectual property rights in and to the App and the Service (including code, design, graphics, layout, trademarks, and technology) belong to the developer of NaitiveKey or its licensors. These Terms do not grant you any ownership rights or title in the App or its components.
3. Custom Layout (Custard) Sharing Feature
The App includes a feature that allows users to upload their customized keyboard layouts ("Custom Layouts") and generate a sharing link so that third parties can download and use them. By using this feature, you agree to the following:
- Public Availability: Once you generate a sharing link for a Custom Layout, that layout becomes accessible to any third party who obtains the link. Do not include any private, personal, or confidential information within shared layouts.
- No Infringement: You warrant that your Custom Layouts do not infringe the copyrights, trademark rights, privacy rights, or other proprietary rights of any third party.
- Storage and Expiration: Uploaded Custom Layouts are stored temporarily and may be deleted automatically after a period of inactivity (typically 30 days since the last download). We do not guarantee the permanent storage of your uploaded layouts.
4. Prohibited Activities
You agree not to engage in any of the following prohibited behaviors:
- Modifying, decompiling, disassembling, or reverse engineering any part of the App.
- Using the Service in any way that puts an excessive load on our infrastructure or systems.
- Uploading or sharing Custom Layouts that contain malicious code, illegal content, or infringe on third-party rights.
- Violating any applicable local, national, or international laws or regulations.
5. Disclaimers and Limitation of Liability
THE APP AND THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- We do not warrant that the App will be error-free, uninterrupted, or fully compatible with all device configurations.
- To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the App, including data loss or device damage.
6. Service Modifications and Termination
We reserve the right to modify, suspend, or discontinue the App or any of its features at any time without prior notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
